Find out what it means for you as new car insurance rules are enforced

A recent change to the law rendered it illegal to keep a vehicle that has not been declared SORN without it being insured. Therefore, even if you don't drive the car, you still must have
car insurance. Until this change it was only an offence to drive an uninsured car.

Coupled with this change, the Government will, in less than a week (starting 20 June 2011) commence continous insurance enforcement (CIE). This will involve cross-checks between DVLA vehicle registration records and the
Motor Insurance Database (MID).

The Motor Insurance Database (MID) is automatically updated with your car registration number (numberplate) and confirmation of valid car insurance whenever you renew your annual cover. Similarly, if you cancel your cover or it expires without renewal, the MID will hold this information.

You can check whether your car is registered as currently insured with the MID by entering your registration number into the askmid search box. If it isn't, you need to check your car insurance documents to confirm that you have currently valid car insurance and if so contact your insurance provider to ask them to update the MID.

If you haven't got current car insurance, you will need to purchase it, otherwise, under the new continuous car insurance enforcement rules, you will be liable to a fixed penalty of £100. If you do not then buy cover, your car could be clamped, seized and disposed of by auction or destroyed. You could also face court prosecution with a fine of up to £1000.

If you are not using your car and it is stored off a public road, you must register your car as SORN with the DVLA which you can do online via their tax disc portal. If the car has a current tax disc, you can return this along with a V14 form to the DVLA for any refund that is due.

If you have recently sold your car, you need to inform the DVLA that you are no longer the registered keeper.

The only exemptions to the need to have car insurance are:
  • if you have made a SORN for the vehicle
  • if your vehicle has been kept off-road since before SORN came into force on 31 January 1998 – unless it was brought back into use
  • if your vehicle is recorded as stolen, passed or sold to the motor trade or between registered keepers
  • if your vehicle is recorded scrapped or permanently exported by the Driver and Vehicle Licensing (DVLA)
Even keepers of cars (or motorcycles) that are only used during the summer must have year-round insurance unless they declare their vehicle SORN and return their tax disc (with a V14 form) when the vehicle is not in use.

Vintage or classic cars manufactured pre-1973 that have a 'nil value tax disc' are still treated as taxed (and therefore are not SORN). To avoid the need for car insurance if they are not in use, they must be declared SORN.

If you are moving abroad and taking your car, if the vehicle is out of the country for less than six months, it would still be subject to UK laws and would need to be insured.
