Buyers Guide: Legal Expenses Cover
Many people are unclear as to
whether they need
legal cover or not when
they buy car insurance. Many decide not to include it, preferring to avoid
the
additional cost. Some policies offer it as standard, including M&S car insurance.
Typically, legal cover costs about £20. This covers, usually, up
to £100,000 of legal costs (for example, to pursue a personal
injury claim) as well as uninsured losses, for example, car hire.
Currently, drivers can afford to be a little relaxed about whether or
not they have legal cover as under current arrangements if they need to
pursue an injury claim on a no win, no fee basis, they are not liable
for legal costs as these are paid by the defendant (the liable car
insurance company) if they win their case and by their own lawyer and
the 'after the event' (ATE) insurance provider (that covers the
defendent's costs) if they do not.
However, this is going to change soon as the government is currently
processing a white paper in line with the Jackson
Report recommendations to scrap the recoverability of these legal
costs from the defendant with the effect that they will be drawn from
the damages award, that is, the claimant will need to pay them. Without
legal cover, he could lose a significant percentage of his damages
award to pay these legal fees.
If he had taken out legal cover (also known as before the event
insurance) with his car insurance, up to £100,000 will be paid
towards these costs.
While the honest driver would hope not to need to use the legal cover
or his car insurance, he could lose a lot of money by omitting legal
cover. When it is such a small percentage of the total cost of his car
insurance, it does make sense not to risk it and to buy legal cover
routinely.
