Car Insurance News Round-Up - September 2011

The September news round-up includes Jack Straw's Motor Insurance Regulation Bill proposals as introduced in his ten minute rule debate in the House of Commons, the Government's confirmation that they will indeed ban legal referral fees in car insurance and the insurance industry's continuing anti-injury lawyers propaganda.

Jack Straw's Motor Insurance Regulation Bill

Jack Straw's Motor Insurance Regulation Bill has been green-lighted by the House of Commons as a result of his 10 minute rule debate, allowing him to introduce his Bill to Parliament on January 20, 2012.

Central to his Bill are kerbs on the sharing of accident victim details, the banning of referral fees and revision downwards of the fees paid to injury lawyers. Government to ban legal referral fees in car insurance

The Government was criticised by the Association of British Insurers (ABI) and other interested parties for failing to include the banning of legal referral fees in litigation (including in car insurance) in its pending legislation that otherwise embraced all the key Jackson Report recommendations.

Not least because of the well-informed interventions of Jack Straw, they have been forced onto the back foot as regards their failure to include a ban on legal referral fees and when it became clear that arguments for the retention of referral fees were thin, they declared themselves 'sympathetic' to a ban which the Ministry of Justice has now announced will indeed be enacted. Cut out injury lawyers to increase compensation says ABI

The Association of British Insurers (ABI) published some further anti-injury lawyer propaganda this month when they argued that removing injury lawyers can increase compensation in road traffic accident and other injury claims.
